1. Purpose of Agreement
This Agreement governs use of the QwikCare iOS app to complete a $10 COVID-19 vaccine prescription encounter. The encounter includes a clinical review by a licensed provider and, when medically appropriate, issuance of a 1-year prescription for a CDC-recommended COVID-19 vaccine.
2. Eligibility & Dependent/Family Access
You may use QwikCare to purchase and complete encounters for:
- Yourself
- Minor children for whom you have legal authority
- Adult dependents with their consent
Each completed encounter results in a separate, individual prescription. QwikCare does not provide lifetime entitlements; prescriptions must be renewed annually through the app by completing new encounters.
3. Payments & Stripe Processing
- All encounter fees are processed securely through Stripe.
- Stripe accepts credit cards, debit cards, and compatible digital wallets.
- Lemur PBC does not store credit card numbers; Stripe handles all PCI compliance.
- Refund requests may be submitted to support@lemurpbc.com.
- Refunds are not guaranteed once a provider review has begun.
4. The COVID-19 Prescription Encounter
Your $10 encounter includes:
- Medical screening questionnaire review
- Provider clinical assessment
- If appropriate, a 1-year COVID-19 vaccine prescription
- Optional follow-up questions by text or phone
5. Provider Review & Medical Judgment
- Providers may approve a prescription immediately if safe.
- Providers may request clarification or follow-up.
- Providers may decline and recommend in-person care if medically necessary.
- Providers may substitute clinically equivalent COVID vaccine formulations.
6. Prescription PDFs & Patient Ownership
- Approved prescriptions are delivered as digitally signed PDF documents.
- These PDFs are stored on your device and fully controlled by you.
- Lemur PBC does not keep a separate copy except as required for HIPAA compliance.
- You may print, AirDrop, or present the PDF at any pharmacy.
7. Pharmacy Use & Limitations
- Pharmacies must follow state law and internal policies.
- Pharmacists may verify your identity and call Lemur PBC using the number on the prescription.
- Lemur PBC cannot guarantee pharmacy stock or pricing.
8. Privacy, HIPAA & Data Handling
Lemur PBC is a HIPAA-covered entity. Your data is used only to:
- Provide clinical care and issue prescriptions
- Verify identity and prevent fraud
- Coordinate with pharmacies when you present your PDF
- (Optional) Retrieve immunization registry history with your consent
Lemur PBC will never sell your data or use your information for advertising.
9. Apple Health (Optional)
- You may sync vaccine administration records to Apple Health.
- You may revoke this permission at any time in iOS settings.
10. Name or Date-of-Birth Corrections
If your prescription contains an error (e.g., name, birthday, spelling, formatting):
Email support@lemurpbc.com and our clinical support team will correct the document as permitted under law.
11. Liability
- Lemur PBC guarantees access to a licensed provider review.
- Lemur PBC does not guarantee pharmacy administration, stock, or reimbursement.
- Prescriptions are issued only when medically appropriate and subject to clinician judgment.
12. Governing Law
This Agreement is governed by U.S. law and the laws of the State of North Carolina.
Acceptance
- You agree to provide accurate information.
- You understand each encounter covers one person for one year.
- You understand payment is through Stripe, not Apple IAP.
- You agree to HIPAA-compliant handling of your PHI.
- You agree that the $10 fee covers the encounter only, not vaccines.
